GENERAL TERMS & CONDITIONS

The purpose of this document is to govern the GENERAL TERMS & CONDITIONS of the online booking services of Sal Rossa Apartments, with registered address at Calle Begonies 4, 07817 Sant Jordi, Ibiza, and VAT code B574806730. The terms "You" and "User" are used herein to refer to any person and/or entity who, for any reason, enters www.salrossa.com or uses the services.

The use of these services implies the full and unconditional acceptance and validity of each and every one of the General Terms & Conditions (which will be automatically incorporated into the agreement entered into with Sal Rossa Apartments without their written transcription) included in the latest updated version of these General Terms & Conditions.

1 USE OF THE BOOKING SYSTEM

The online booking services are intended for booking a room at Sal Rossa Apartments.

THE USE OF THESE SERVICES IMPLIES THE FULL AND UNCONDITIONAL ACCEPTANCE AND VALIDITY OF EACH AND EVERY ONE OF THE GENERAL TERMS & CONDITIONS INCLUDED IN THE LATEST UPDATED VERSION OF THESE GENERAL TERMS & CONDITIONS.

BOOKING PROCESS

Each time the service is used by the User, they will receive a confirmation email, including information that their booking is in the process of being confirmed. If the User becomes a customer once the total amount or deposit corresponding to the booking has been charged, they will receive an email confirming the booking, which will serve as proof of booking. The booking is not confirmed without this proof and proof of payment.

GUARANTEE

The booking is confirmed and guaranteed overnight with a credit card. If the guest is a no-show, the first night will be charged (including VAT and taxes).

CANCELLATIONS

The credit card is merely a guarantee. The customer will not be charged a cancellation fee as long as the cancellation is made before the set time (in the hotel's local time). After this time, Sal Rossa Apartments will charge a cancellation fee.

The cancellation fee for Sal Rossa Apartments is equal to the price of the first night (including VAT and taxes).

Cancellations made 2 days before the check-in date will not be charged.

RATES AND TAXES

The rates shown on our website are valid for the stated period. Where there are justifiable reasons, Sal Rossa Apartments reserves the right to change these rates without prior notice.

Rates for a specific booking are displayed during the booking process. VAT/taxes are included in the rates, as are additional any applicable local taxes.

Special taxes such as Sustainable Tourism Tax are not included.

2 USE OF THE WEBSITE SERVICES

The User undertakes to use the services in accordance with the law, decency, respectability, and law and order, and in accordance with the provisions of these General Terms & Conditions. Consequently, the User will refrain from using the services for illicit purposes and effects and/or for purposes contrary to the provisions of these General Terms & Conditions, in a way which may be detrimental to the rights and/or interests of third parties or which in any way may damage Sal Rossa Apartments and/or its image or services.

Sal Rossa Apartments may at any time, and without prior notice, modify the services provided or the operating, technical or general terms and conditions of the services. Similarly, in order to improve service and guarantee an optimal level of quality, the User is invited to suggest any modifications which they may consider useful by contacting Sal Rossa Apartments.

3 CORRECT USE OF WEBSITE CONTENT

All material included on www.salrossa.com and on any other website owned, operated, licensed or controlled by Sal Rossa Apartments, such as texts, graphics, logos, images and photographs, is the property of Sal Rossa Apartments, its subsidiaries, affiliated companies and/or third-party licensees, and is protected by Spanish and international copyright laws. Modification or use of the content, except as explicitly stated in these General Terms & Conditions, infringes the intellectual property rights of Sal Rossa Apartments.

Content may not be copied, distributed, published, uploaded, or transmitted in any way without the prior written consent of Sal Rossa Apartments.

4 RIGHT TO MODIFY THE GENERAL TERMS & CONDITIONS.

Sal Rossa Apartments reserves the right to modify these General Terms & Conditions, duly informing users of the modifications made on www.salrossa.com.

5 GUARANTEE AND DISCLAIMER

The Sal Rossa Apartments website does not guarantee the reliability, availability or continuity of the online services made available to the User and, consequently, disclaims all liability for damages and/or losses of any kind which may be due to the lack of these. However, and wherever possible, it will endeavour to provide technical assistance to the person concerned. Likewise, Sal Rossa Apartments will attempt to resolve the interruption and, whenever possible, will provide the User with alternative measures.

5.2 Sal Rossa Apartments does not control and has not previously controlled the content of the presence of viruses or other elements which may alter the software or hardware of the User or website visitors and, consequently, is not liable for any damage and/or losses of any kind which may derive from them.

5.3 If, despite due diligence and foresight, Sal Rossa Apartments cannot provide the booked rooms for reasons which are not attributable to Sal Rossa Apartments, or if it is impossible to provide the services according to the agreed terms and conditions, Sal Rossa Apartments will offer the User the possibility to choose between a refund of the total amount paid or a substitute room of a similar category or quality. If, as a result of the substitute room, the service is of a lower category or quality, Sal Rossa Apartments will reimburse the difference.

6 GENERAL

If any provision of these General Terms & Conditions is declared null and void or cannot be enforced, the remaining Terms & Conditions will remain in force. Sal Rossa Apartments undertakes to replace the provision in question with a provision which fulfils the intention initially pursued by the parties.

NOTHING IN THIS AGREEMENT WILL IN ANY WAY AFFECT THE MANDATORY PROVISIONS OF CONSUMER-RELATED REGULATIONS. IF YOU ARE NOT A CONSUMER, PLEASE EXPLICITLY EXPRESS YOUR RIGHT OF WITHDRAWAL.

7 ACCEPTANCE OF THE RULES OF USE.

The User is aware of the fact that using the online booking services implies the full and unconditional acceptance of each and every one of the provisions of the rules of www.salrossa.com in the version published by Sal Rossa Apartments when the User books the service. Said Rules of Use complete these General Terms & Conditions in all non-conflicting aspects. Consequently, the User understands of the importance of reading the rules of the website before entering it and/or using the services.

8 GOVERNING LAW

These General Terms & Conditions are governed by Spanish law. To resolve any dispute which may arise in relation to their total or partial validity, execution, compliance or resolution, Sal Rossa Apartments and the User explicitly waive their own or any other corresponding jurisdiction and agree to comply with the jurisdiction of the Courts and Tribunals of Ibiza. This contract is the entire and complete agreement between Sal Rossa Apartments and the User and supersedes all prior covenants, commitments, representations and agreements, whether written or oral, which may have previously existed between both parties.

In any case, any dispute which may arise due to the provision of services at the hotel where the guest is staying will be submitted to the Courts and Tribunals of Ibiza.
